1. Eligibility: The Essentia Nation Rewards Football Spin To Win Game (the "Game") is open only to legal residents of the 50 United States, and District of Columbia who are 18 years or older (or 19 if resident of AL or NE) and are an Essentia Nation Rewards Program member (each, an “Entrant”). Employees of Nestle USA Inc. (“Sponsor”), Brandmovers, Inc. (“Administrator”), and/or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Game (collectively with Sponsor, the "Promotion Entities") and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children and their respective spouses, regardless of where they reside) and household members of each such employee, whether or not related, are not eligible to enter or win. The Game is subject to all applicable federal, state, and local laws and regulations. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's and Administrator’s decisions, which are final and binding in all matters related to the Game. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Game Period: The Game begins on September 29, 2025, at 12:00:01 AM Eastern Time ("ET") and ends on October 13, 2025, at 11:59:59 PM ET (the "Game Period").
3. How to Play the Game: You must be a registered member of the Essentia Nation Rewards loyalty program. Entrants who are not yet members may register for free by visiting www.essentianationrewards.com/register and completing the registration form. Upon registration for new members, or upon logging in at www.essentianationrewards.com for existing members during the Promotional Period, the Entrant must first agree to these Official Rules. Then, to participate, click on the “Begin Survey” button and answer the four (4) survey questions, and upon submitting answers to all four (4) survey questions, Entrant will unlock one (1) chance to spin the prize wheel. Click on the Spin the Wheel button to spin the wheel to reveal your prize or reward, subject to eligibility verification. Click the “Secure My Prize” button and complete the information and an email verification will be sent to the email address associated with your Essentia Nation Rewards account. Limit one (1) entry/spin per person during the entire Sweepstakes Period.
4. Winner Notification and Verification: First, Second, or Third Prize; The First, Second, or Third Prize winners will receive a verification email and confirmation which will include the mailing address the Prize will automatically be shipped to. Winners will have 24 hours to correct any inaccurate address appearing in their winner notification email. If no correction is made or is necessary, the Prize will automatically be shipped to the First, Second and Third Prize winner. Allow 6-8 weeks for mailing. Neither Sponsor nor Administrator are responsible for stolen, lost, late, damaged, or misdirected mailing of any Prize. Fourth Prize & Consolation Prize: The winner of any Essentia Nation Rewards points will receive a verification email and the points will automatically be credited to the recipients’ Essentia Nation Rewards account. Fifth Prize; The Fifth Prize winner will receive an email which will contain a button/link that the winner must select to download their prize. Neither Sponsor nor Administrator are responsible for emails that go into the SPAM or Junk folder, are undeliverable, or for any technical glitches interfering with the message being sent or received. Subject to eGift terms and conditions, restrictions may apply. In the event of a dispute regarding who submitted a registration, entry or who earned an entry or prize, will be deemed submitted by the authorized account holder of the e-mail address at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No automatically generated entries will be accepted.
There will be a total of: Three (3) First Prizes, Five (5) Second Prizes, Thirty (30) Third Prizes, Fifty (50) Fourth Prizes, One Hundred (100) Fifth Prizes available during the Game Period. In addition, all other eligible participants who spin the wheel and do not win one of the prizes listed above will automatically receive a consolation prize of one hundred (100) Essentia Nation Rewards points (“Consolation Prize”). An unlimited number of Consolation Prizes are available. Winners of the First through Fifth Prizes will be determined from a randomly populated time-stamp table of predetermined times each day during the Game Period. For purposes of this Game, a “day” begins at 12:00:00 AM ET and ends at 11:59:59 PM ET. Odds of winning a First through Fifth Prize depends on the time of Game play and the number of such prizes remaining. Odds of receiving the Consolation Prize are 100% for all eligible participants who do not win a First through Fifth Prize. Limit one (1) prize (including the Consolation Prize) per person during the entire Game Period. Sponsor's decisions as to the administration and operation of the Game is final and binding in all matters related to the Game. THE POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY ADMINISTRATOR AND SPONSOR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE GAME.
First Prize - Three (3): Essentia Branded Bose Bluetooth Speaker. ARV: $210.00 each.
Second Prize - Five (5): Essentia Branded Football Toss Game. ARV: $200.00 each.
Third Prize - Thirty (30): Essentia Branded Bucket Hat. ARV: $20.00 each.
Fourth Prize - Fifty (50): 350 Essentia Nation Rewards Points. ARV: ENR points have no cash value and no retail value outside of the Loyalty Program.
Fifth Prize - One hundred (100): A Walmart eGift Card. ARV: $5.00 each.
Consolation Prize - Unlimited: 100 Essentia Nation Rewards Points, awarded to each eligible entrant who spins the wheel but does not win a First, Second, Third, Fourth or Fifth Prize. ARV: ENR points have no cash value and no retail value outside of the Loyalty Program.
Points cannot be redeemed for cash. All warranties and guarantees are subject to manufacturers’ warranties and guarantees. Prizes cannot be used in conjunction with any other Game or offer. Prizes are subject to availability, non-transferable, non- negotiable, non-refundable and no substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute a Prize for one of equal or greater value for any reason. Walmart eGift card is subject to the terms, conditions and restrictions accompanying the eGift card, restrictions may apply. All taxes (including, without limitation, state and federal income taxes) and the reporting consequences thereof associated with the use and acceptance of a prize or reward is solely the responsibility of each winner or reward recipient. Sponsor makes no warranties, and hereby disclaims all warranties, express or implied, concerning any Prize furnished in connection with the Game. Total ARV of all prizes: $2,730.00
By entering, each entrant agrees to release, indemnify, defend and hold harmless the Promotion Entities from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's entry, creation of an entry or submission of an entry, participation in the Promotion, acceptance or use or misuse of prize (including any travel or activity-related thereto) and/or the broadcast, exploitation or use of entry.
Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, for any reason whatsoever, including, without limitation, fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction or if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. If the Promotion is terminated before the designated end date, Sponsor will (if possible) award the Grand Prizes and any unclaimed Instant Win Game prize in a random drawing from all eligible, non-suspect entries received for the Sweepstakes as of the date of the event giving rise to the termination or as otherwise deemed fair and appropriate by Sponsor. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Entrant further agrees and acknowledges that Sponsor reserves the right to forfeit or award any unclaimed or leftover Prize at its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner and void all associated entries, game plays, and/or prizes claims. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of prizes described in these Official Rules will be awarded. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
The Promotion Entities as set forth above are not responsible for: (1) for late, lost, jumbled, garbled, misdirected, delayed, incomplete, incorrect, or inaccurate entries, game plays, prize claims, email, mail, or other communications of any kind, whether caused by any of the equipment or programming associated with or utilized in this Promotion or by any human error; (2) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (3) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (4) unauthorized human intervention in any part of the entry process or the Promotion; (5) technical, network, mechanical, typographical, human or other error or problem which may occur in connection with the Promotion, including, but not limited to, errors or problems which may occur in the administration of the Promotion or the processing of entries, game plays or prize claims, the announcement of the prizes, or in any Promotion-related materials; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any prize (including any travel or activity-related thereto). If for any reason an entry or game play is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry or game play in the Promotion, provided that the Promotion has not been terminated.
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion, other than those concerning the administration of the Promotion or the determination of Winners or for any disputes arising from the loss or injury from the participation in a Prize, shall be resolved individually, without resort to any form of class action; (ii) any disputes arising out of these Official Rules (except for any disputes arising from the loss or injury from the use of Prizes) shall be submitted to final, binding arbitration conducted in the State of Virginia under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. before a single, neutral arbitrator who is a former or retired Virginia state or federal court judge with experience in entertainment matters who shall follow Virginia law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in the state of Virginia, including an award of costs, fees and expenses incurred in enforcing the award. Notwithstanding the foregoing, Released Parties shall be entitled to seek injunctive relief (unless otherwise precluded by any other provision of these Official Rules) in the state and federal courts of the state of Virginia. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Official Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in the state of Virginia; (iii) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the State of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Virginia.
Information collected from Entrants in connection with the Sweepstakes shall be used in accordance with Sponsor’s privacy policy, available at https://www.nestleusa.com/privacy.
